What counts as IT, software and technology

This industry covers two divisions of section J “Information and communication”. Not included are telecommunications providers (division 61), publishers including publishers of standard software (58) and hardware manufacturers, which belong to manufacturing.

The classes of division 62 are broad. A freelance developer, a digital agency and a software house with several hundred employees can all be classified under 62.01.

No professional register – but almost always a legal notice

In Germany, IT services require neither a licence nor membership of a professional chamber. There is therefore no official directory of the industry.

Legal notice under § 5 DDG
Anyone offering digital services on a commercial basis must keep their name, address, an email address, the register and register number and – where available – the VAT identification number easily recognisable (§ 5 DDG). In this industry, the company’s own website is the richest public source.
Commercial register
IT companies in the legal form of a GmbH or UG are in division B; the object of the company is registered as well (§ 43 HRV). It is free text and often broadly worded (“development and sale of software and all related business”).
Freelance IT professionals
Whether a self-employed developer or consultant is a trader or a freelancer is decided case by case. Freelancers are not in any register; they are only visible via their own website.

Not in the export

  • technologies, programming languages and products
  • vendor partnerships and certifications
  • number of developers and turnover
  • names of managing directors or technical leads as a separate column
  • customer industries and references

These 15 columns are included.

The code says a company does IT – not what kind

Programming language, platform used, vendor partnership or industry focus are not features of the classification. If you are looking for “SAP consultancies” or “Shopify agencies”, there is no code for them. The short description of activities from the website can give a hint; it is not a reliable filter.

After a change of name or registered office, the register entry is correct immediately, the website often only later. Where the two sources contradict each other, the data status date is what matters.

If a company is based in a shared office, a start-up centre or at the address of a business centre, several companies share one address. That is not an error in the list. For postal advertising, the company name in the address line is therefore essential.

Questions

IT, software and technology: frequently asked questions

Not cleanly. Class 62.01 contains all three. The legal form (GmbH, UG, AG versus sole proprietorship) is the only filter that can be applied reliably; it separates by organisational form, not by business model.

There is no “start-up” field; the founding date is not a column in the planned export. A young company can only be included if the data status date is after its founding and it appears in the dataset’s sources.

No. Publishing it in the Impressum is a legal obligation, not consent to advertising. § 7(2) no. 2 UWG requires prior express consent for marketing emails, between businesses as well.
